Este jueves 29 de Diciembre la Secretaría de Hacienda y Crédito Público (SHCP) da a conocer a través del Diario Oficial de la Federación (DOF) las Reglas de Operación para Apoyos a los Sectores Agropecuario, Forestal, Pesquero y Rural.
La Ley Federal de Presupuesto y Responsabilidad Hacendaria (LFPRH) en su artículo 77 establece que en el Presupuesto de Egresos se señalarán los programas que deberán sujetarse a Reglas de Operación con el objeto de que la aplicación de los recursos públicos se realice con base en criterios de eficiencia, eficacia, economía, honestidad y transparencia.
El otorgamiento de los apoyos previstos en estas Reglas de Operación estará sujeto a los recursos presupuestales incluidos para tal fin en los flujos de efectivo de los fideicomisos que integran a los Fideicomisos Instituidos en Relación con la Agricultura (FIRA) conforme a lo aprobado en el Presupuesto de Egresos del año correspondiente y en los términos aprobados por los Comités Técnicos de FIRA.
Los fideicomisos que integran FIRA destinarán recursos a cada uno de los apoyos que comprenden estas Reglas de Operación, los cuales podrán ser redistribuidos entre cada uno de ellos en función de la demanda que se observe. En el presente documento se establece la forma en que operarán los diversos apoyos de los fideicomisos que integran FIRA (FONDO, FEFA, FEGA y FOPESCA).
Las presentes Reglas de Operación tienen como propósito fortalecer la organización de productores para facilitar su acceso al financiamiento y su integración en las redes de valor; así como desarrollar la productividad, rentabilidad e integración de sus empresas, propiciando la sostenibilidad de los recursos, según se indica en el documento.
Los apoyos previstos en las presentes Reglas de Operación tendrán cobertura nacional, excepto los servicios de capacitación y misiones comerciales o tecnológicas que también pueden llevarse a cabo en el extranjero.
Los solicitantes de los apoyos a que hacen referencia las presentes Reglas de Operación deberán identificarse mediante la clave del Registro Federal de Contribuyentes (RFC) en el caso de personas morales o la Clave Única de Registro de Población (CURP), en el caso de personas físicas.
FIRA podrá verificar los presupuestos y cotizaciones que presenten los solicitantes, con base en las condiciones prevalecientes en el mercado que corresponda, así como la relación de beneficiarios y los comprobantes de gastos realizados. De ser necesario, FIRA podrá solicitar información adicional para mayor soporte al dictamen de la solicitud de que se trate.
No se autorizarán apoyos a los solicitantes, personas físicas o morales, que hayan causado un daño patrimonial a cualquiera de los fideicomisos que integran FIRA, o participado como socios o como miembros de los órganos de administración de Intermediarios Financieros que hayan causado un daño patrimonial a cualquiera de tales fideicomisos.
